Motherwell Contaminated Land Test Case to be Heard at Edinburgh Court of Session

On Tuesday 12th November, a preliminary proof – or test – case relating to the contaminated land at Watling Street in Motherwell will commence at the Edinburgh Court of Session.

This relates to the ongoing civil case of Robert and Angela McManus, who lived on the site between 2000 and 2012, against SWK (Scott Wilson).

SWK (Scott Wilson) was appointed, historically, to supervise the reclamation and decontamination of contaminated land at the former Metropolitan-Vickers/Sachwell Sunvic factory before a housing estate was built on the site.

“This case is the latest test case in a long running dispute aimed at determining responsibility for the unacceptable remediation of contaminated land following the conversion of an industrial factory to domestic housing in the 1990s.

It has the potential to have significant ramifications for a number of other households on the Watling street site, the residents of which have been affected for a number of years.”
